By accessing and using yomatik (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services.
2. Description of Service
yomatik provides an AI-powered receptionist service for businesses, including call handling, appointment scheduling, and customer communication tools. You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges).
3. User Account
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Payment and Subscription
Usage of yomatik is subject to subscription fees. Use of the Service may be subject to recurring fees, which are non-refundable except as required by law. We reserve the right to change our prices at any time, but we will provide notice of these changes.
5. Use of AI and Data
Our Service utilizes Artificial Intelligence technologies. You acknowledge that AI outputs may not always be 100% accurate. You retain ownership of your data, but grant us a license to use it to provide and improve the Service, including training our AI models in an anonymized manner.
6. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Limitation of Liability
In no event shall yomatik, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
